 1st Meeting of Tribunal Scheduled

THE ICSID TRIBUNAL IS FORMED 


13 May 2008 - Sidley Austin confirms Costa Rica's availability for the 1st meeting of the tribunal. 

12 May 2008 - 1st meeting of the tribunal is scheduled for 27 June 2008. 

2 May 2008 - Dr. Morelli accepts nomination as president of the tribunal and the tribunal is formed. 

24 April 2008 - ICSID appoints Dr. Sandra Morelli, a Colombian national, as President of the Arbitration Tribunal
25 March 2008 - Costa Rica retains Sidley Austin LLP as their legal representative. 

11 Jan 2008 - CLCW officially opposes proposed nomination of Dr. Morelli and suggests other more qualified arbitrators to preside over the tribunal. 

30 Nov 2007 - ICSID proposes nomination of Dr. Sandra Morelli Rico, a Colombian professor who taught in Canada and Europe, as the President of the Tribunal.  Dr. Morelli was a member of the ICSID tribunals in the cases of Sempra Energy v. Argentina and Camuzzi Internacional v. Argentina. 

28 Sept 2007 - ICSID notifies the parties that Dr. Raul Vinuesa has accepted his appointment as Costa Rica's nominee as arbitrator (arbitrator #2).

18 Sept 2007 - ICSID notifies the parties that it will proceed in the nomination of the 3rd arbitrator (the President of the Tribunal) since the parties have not been able to agree on this person.   Also, ICSID notifies that Prof. Vinuesa has yet to accept his appointment as Costa Rica's nominee as arbitrator (arbitrator #2).

6 Sept 2007 - ICSID notifies CLCW of Costa Rica's nomination of Prof. Raul Vinuesa.
4 Sept 2007 - Administrative Council of ICSID requested to select an arbitrator for Costa Rica and to appoint Professor Reisman as President of the Tribunal.  

31 Aug 2007 - Costa Rica nominates Professor Raul Emilio Vinuesa, an Argentine national, as their member of the tribunal, rejects submission of Prof. Reisman as President, and asks ICSID to select the President.  Notification is not relayed by ICSID to CLCW until 6 Sept 2007. 

28 Aug 2007 - Costa Rica approves Law 8593 and budgets initial 81,750,000 colons (about $158,737) to pay for ICSID arbitration.

8 Aug 2007 - PROF. SALACUSE APPOINTED AS MEMBER OF TRIBUNAL.  Prof. Jeswald W. Salacuse has been appointed as the 1st member of the ICSID tribunal. 

27July 2007 - TRIBUNAL NOMINEES SUBMITTED. CLCW has submitted the names of two Americans as nominees in the formation of the ICSID arbitration tribunal.  The nominees are Prof. W. Michael Reisman (as President) and Prof. Jeswald W. Salacuse (as Member).  Costa Rica has not yet submitted any nominee.

27 March 2007 - ARBITRATION REGISTERED.   Registered as case number ARB(AF)/07/03 under the ICSID Additional Facility Rules (AFR).

16 May 2007 - OSVALDO VILLALOBOS FOUND GUILTY.  Osvaldo Villalobos was found guilty of  illegal financial intermediation and fraud by a 3-judge panel.  He was acquitted of money laundering.  The sentence for 18 years of prison is under appeal and he awaits his appeal under custody in prison.

A new section has been added under DOCUMENTS called FEEDBACK LETTERS & EMAILS, which provide opinions of investors and other interested parties in the progression of the arbitration.
